Bad Faith Insurance Claims
Axley's attorneys have vast experience analyzing insurance
policies. In addition to determining the nature and extent of coverage,
we regularly review policies and claims files to determine whether
insurance companies have acted in "bad faith" in making coverage
decisions. We have assisted people in disputes with their own insurance
companies and have litigated on their behalf successfully. By
the same token, we have successfully represented insurance companies in
such claims by insured parties. Regardless of whether you are
an insurance company, or insured by one, retaining the Axley firm will
bring a great deal of knowledge and experience to dissecting the
sometimes tangled web of insurance coverage issues in potential bad
faith situations.
Our ability to identify bad faith scenarios has also allowed us to
preemptively advise our insurance company clients in analyzing their
obligations to their insureds and charting a course of action to avoid
bad faith litigation. We have filed and handled many declaratory
judgment actions to conclusion to determine an insurer's obligation to
its insureds and others, and have had great success with many of these
cases.
In addition to acting as litigators and advisors to both insurance
companies and insureds in this field, a number of our attorneys have
been retained as expert witnesses in bad faith litigation, showing that
Axley attorneys are respected and relied upon by other attorneys in the
field of insurance coverage and bad faith.
Axley also has attorneys who have worked in claims departments for
insurance companies and can add that pragmatic inside perspective to
cases we review and litigate on behalf of our clients. Whenever
possible, we attempt to assist insurers and their insureds reach an
understanding as to the scope of coverage so that misunderstandings,
and litigation, can be avoided. When that is not possible, we
vigorously advocate for our clients to obtain the best possible result.
