Wisconsin state, local and some quasi-governmental entities exercise eminent domain or condemnation by taking private property for public use to build roads, sewers, power lines and other public works. Wisconsin state law requires a government to pay the property owner for the fair market value of the property when it exercises its eminent domain authority and condemns private property. Governments also must follow a particular set of steps when condemning private property.
Axley’s real estate and land use attorneys have extensive knowledge of the complex laws surrounding condemnation of real estate, and experience representing both public and private sector clients. On the public side, we represent municipal governments, drainage districts, sewerage districts and utility companies to obtain real estate for the public good. On the private side, we represent private landowners and developers in every aspect of a condemnation, including advising appraisers of special factors affecting your property, coordinating appraisals on your behalf, negotiating with the government regarding a proposed condemnation award and, if necessary, filing suit to ensure fair compensation.
