Daniel McAlvanah is a member of Axley’s Litigation Practice Group, Labor and Employment Group, and Class Action Team. His practice focuses on employment law and class action litigation with particular emphasis on wage and hour class actions under the federal Fair Labor Standards Act. Mr. McAlvanah also serves as a member of the firm’s Electronic Discovery Committee.

Mr. McAlvanah is admitted to practice in the state courts of Wisconsin, the United States District Courts for the Western and Eastern Districts of Wisconsin and the Central District of Illinois, and the United States Court of Appeals for the Seventh Circuit.

Mr. McAlvanah received his law degree from the University of Wisconsin Law School in 2006, where he served as Senior Managing Editor of the Wisconsin Law Review. Prior to law school, Mr. McAlvanah worked as a professional restaurant critic in New York City. He was nominated for a James Beard Journalism Award in 2001.

Significant Representations:

  • Obtained summary judgment in favor of health care organization which was sued on a Title VII religious discrimination claim.
  • Sjoblom v. Charter Communications (W.D. Wis. Case No. 07-cv-431-C). Participated in prosecution and settlement of an FLSA hybrid action for unpaid wages and overtime filed on behalf of a class of cable installers.  
  • Goodell v. Charter Communications (W.D. Wis. Case No. 08-cv-512-C). Participated in prosecution and settlement of a multi-state Rule 23 class-action filed on behalf of cable installers.  
  • Wilcox v. Alternative Entertainment, Inc. (W.D. Wis. Case No. 09-cv-659-C). Participated in prosecution and settlement of a Rule 23 class-action involving claims for unpaid overtime and wage deductions under Wisconsin law.
