Troy Thompson is a partner and practice group leader of the Labor and Employment Practice Group. He is also a member of the firm's Litigation Practice Group. Mr. Thompson represents private and public sector employers in all facets of traditional labor and employment, litigation and other business matters.

In addition to advising employers on day-to-day issues relating to personnel polices and practices affecting the labor force, Mr. Thompson represents the interests of management in actions pending before federal and state courts, as well as in administrative hearings and appeals. Mr. Thompson has appeared and practiced before the National Labor Relations Board (NLRB), the United States Equal Employment Opportunity Commission (EEOC), the Wage and Hour Division of the United States Department of Labor (DOL), the Occupational and Safety Health Administration (OSHA), the Wisconsin Employment Relations Commission (WERC), the Wisconsin Wage and Hour Division, the Wisconsin Equal Rights Division (ERD), the Wisconsin Worker's Compensation Division, the Wisconsin Unemployment Insurance Division and the Madison Equal Opportunities Commission (MEOC). Mr. Thompson's review of a treatise entitled, "Business and Commercial Litigation in Federal Courts," was published in the Wisconsin Lawyer.

While attending law school at Marquette University, Mr. Thompson served as legal intern to the National Labor Relations Board, and separately with the Wisconsin Court of Appeals, District 1.

Mr. Thompson is admitted to practice before the United States District Courts for the Eastern and Western Districts of Wisconsin, the United States Court of Appeals for the Seventh Circuit and all Wisconsin state courts.

Significant Representations:
  • On behalf of an acute care hospital, a nursing home, a national blood bank, a school district and a municipal police department, defended several union organizational drives with petitions for election filed before the National Labor Relations Board (NLRB) and/or Wisconsin Employment Relations Commission (WERC)
  • On behalf of an acute care hospital, defended "objections to election" and unfair labor practice charges before National Labor Relations Board (NLRB)
  • On behalf of a credit union, served as lead spokesperson during collective bargaining negotiations for a successor contract
  • On behalf of a municipality, defended against former employee's state court appeal of prohibited practice complaint under Wisconsin Municipal Employment Relations Act (MERA)
  • On behalf of an acute care hospital and home health care provider, obtained dismissal of registered nurse's federal Fair Labor Standards Act (FLSA) lawsuit, pending before United States District Court for the Western District of Wisconsin
  • On behalf of a manufacturer, helped obtain dismissal of former employee's federal Age Discrimination in Employment Act (ADEA) complaint, pending before United States District Court for the Eastern District of Wisconsin
  • On behalf of a printing company, obtained dismissal of former employee's federal Family and Medical Leave Act (FMLA) complaint, pending before United States Department of Labor
  • On behalf of a manufacturer, obtained dismissal of former employee's Wisconsin Fair Employment Act (WFEA) sexual harassment and gender discrimination complaint, pending before State of Wisconsin Equal Rights Division
  • On behalf of printing company, obtained dismissal of former employee's federal military leave complaint under Uniformed Services Employment and Reemployment Rights Act (USERRA), pending before United States Department of Labor
  • On behalf of a healthcare institution and national blood bank, obtained dismissal of former employee's whistleblower/retaliation complaint, pending before Occupational Safety and Health Administration (OSHA)
  • On behalf of several clients, obtained dismissals of Wisconsin Fair Employment Act (WFEA) disability, gender and race discrimination complaints, pending before State of Wisconsin Equal Rights Division
  • On behalf of insurance carriers and employers, defended primary worker's compensation claims and "unreasonable refusal to rehire" penalty claims, pending before Wisconsin Worker's Compensation Division
  • Assisted clients design and implement reductions-in-force (RIFs) and Early Retirement Incentive Programs (ERIPs) in compliance with federal Age Discrimination in Employment Act (ADEA) and federal and state Worker Adjustment and Retraining Acts (WARN)
  • Assisted clients draft and enforce Employee Confidentiality, Non-Compete, Non-Solicitation and other Restrictive Covenants
  • Provided human resources training to clients, human resources professionals and employer organizations
