Facts: This matter handled procedural and substantive
issues relating to forum selection clauses under the Wisconsin Fair
Dealership Law and the Wisconsin Franchise Investment Law.
Ruling: The Court found that the forum selection clause requiring
venue in states other than Wisconsin was not unenforceable under the
Wisconsin Fair Dealership Law because the Court found that the Wisconsin
Fair Dealership Law was not applicable.
Bottom Line: The Wisconsin Fair Dealership Law has
prohibitions against contracting around its requirements that affect
both choice of law and forum selection clauses.
