Wrongful Death
Wrongful death is generally caused by another person's negligence, recklessness, malpractice or inaction. A bicyclist killed by a drunk driver, a child struck and killed by a careless teenage motorist, and a woman murdered by her ex-husband are examples of wrongful deaths. In wrongful death cases, the family of the victim can file a wrongful death personal injury claim to help recover damages for pain and suffering, lost wages, mental anguish, loss of companionship, medical costs and other expenses.

Immediate family members, including parents, spouses and children, are almost always eligible to file a claim. Additionally, other family members such as stepparents, grandparents and dependents may also file suit in some states.
