Attorney Elizabeth Stephens is a senior associate in Axley’s Madison office where she focuses her practice on general civil litigation, labor and employment matters, and municipal law. Her legal experience extends to both the private and public sectors, including acting on behalf of municipal and business interests as a lobbyist.

Civil Litigation

Attorney Stephens has a wealth of experience handling general civil litigation matters and routinely appears before federal trial and appeals courts, state courts, administrative agencies, and municipal courts. Attorney Stephens represents employers, municipalities, individuals, and public and private entities in litigation relating to constitutional and civil rights claims, public procurement, property taxation, judicial review of agency decisions, insurance defense and other civil disputes. She successfully manages all facets of litigation, from risk assessment, to pre-trial strategy, settlement negotiations, and trial strategy.

Labor and Employment

Attorney Stephens’ labor and employment practice involves representation of private and public employers in both formal and informal proceedings before state and federal agencies, including the EEOC, NLRB, DWD, and LIRC.

Attorney Stephens advises employers on internal operating procedures and employment documents for regulatory compliance, and develops and presents employee and management training sessions related to established and evolving employment law issues. In addition, she drafts and reviews employment agreements, non-compete and non-solicitation agreements and employee handbooks and frequently oversees out-of-court resolutions of employment disputes.

Attorney Stephens stays apprised of the latest employment law issues along with the application of FMLA, ADA, WFEA, FLSA, NLRA laws, and is the co-author of the Wisconsin Attorney’s Desk Reference chapter covering FMLA policies in Wisconsin.

Municipal Law

Attorney Stephens’ experience, knowledge, relationships with, and understanding of municipal government is unparalleled. Her relationships extend not only to executives and administrators charged with overseeing and executing municipal operations, but also to corporation counsel, special counsel, board and council members, clerks, law enforcement officials, and others.

In addition to routinely defending municipal clients in court, Attorney Stephens municipal law practice includes overseeing and advising municipalities on statutory, administrative, and regulatory compliance issues. She also handles municipal taxation issues, including property tax, room tax issues as well as other questions related to general municipal law. Attorney Stephens has also developed road agreements, model ordinances, and advised on employment matters, such as leave and progressive disciplinary policies and investigations.

Attorney Stephens has been a regular presenter at the National Association of Counties, the National League of Cities, and the Wisconsin Counties Association. She has appeared before common councils and county boards across the country and served as a lobbyist for various municipal entities.

When she is not in the office, Attorney Stephens is an equestrian and hiker.
