As you assist your child with packing for the perfect college dorm room, it is essential to ensure you and your child are prepared for any situation. As every teenager happily reminds us, turning 18 makes one legally an adult. This means that as a parent, you no longer have authority to make medical or financial decisions on their behalf, even in the event of an emergency. Before your child leaves the nest, ensure your child has a Healthcare Power of Attorney (HCPOA), a HIPAA Authorization, and a General Durable Power of Attorney (GDPOA).

A HCPOA appoints an agent to make medical decisions for your child if your child is no longer able to make their own decisions. A HIPAA Authorization gives the named agent the ability to ask for and receive information from healthcare providers for your child. A GDPOA authorizes an agent to make financial decisions on your child’s behalf.  A GDPOA authorizes a parent (or other designee) to handle financial affairs like paying bills, managing bank accounts, applying for a lease, or conducting legal or other financial affairs on their behalf.

Emergency situations may happen when your child is at college. While your child is legally an adult, they still need your help. Without these documents, you may be required to obtain court approval to assist your child in an emergency situation. Obtaining court approval takes time and can be very costly.
