Axley’s condemnation attorneys regularly represent utilities, municipalities, and other acquiring agencies to obtain property rights throughout the State of Wisconsin. We combine our intimate knowledge of real property and eminent domain law with decades of negotiation, litigation, and trial experience. We work closely with condemning authority clients to ensure that they acquire all rights necessary for their project in a fast, efficient, and cost-effective manner.

Over the last decade, Axley has represented condemning authorities in some of the largest public projects in Wisconsin, including the Cardinal-Hickory Creek, Badger Coulee, and CapX transmission line projects. For these projects, Axley was involved in acquiring easement rights on hundreds of properties located throughout Wisconsin.

Axley assists acquiring agencies with all steps that arise during the condemnation process, including acquisition planning and pre-negotiation questions, negotiations with landowners, and trials if those negotiations are not successful. Since 2010, Axley’s condemnation attorneys have handled over 20 jury trials involving condemnation matters. There are very few, if any, firms in Wisconsin with this level of trial experience in eminent domain matters.

Given the breadth of its work, Axley has professional relationships with many appraisers, engineers, and contractors that also have expertise in eminent domain matters. These relationships allow Axley to obtain fair results, and, if necessary, try cases effectively and successfully. Axley’s attorneys are skilled in working with their clients and appraisers to address various issues that arise in condemnation litigation, such as larger parcel and highest and best use disputes, claims of health impacts caused by electrical facilities, and disputes over easement interpretation.

All of these factors combined with our experience ensure that Axley condemnation and eminent domain attorneys are proficient and knowledgeable in all aspects of the condemnation process, from the point in time when the condemning authority begins its acquisitions, through landowner negotiations, and through trial and appeal.
